Sportfishing Report Terms and Conditions

These Terms and Conditions (the “Terms”) govern your access to and use of SPORTFISHINGREPORT.COM and any websites, services, features, accounts, content, and data operated by Sportfishing Report, Inc. (collectively, the “Service”). By accessing or using the Service, you agree to these Terms. If you do not agree, do not access or use the Service.

1. Permitted Use

1.1 Sportfishing Report, Inc. grants you a limited, revocable, nonexclusive, nontransferable license to access and use the Service for your personal, noncommercial use, subject to these Terms.

1.2 Any commercial use, redistribution, republication, syndication, automated access, or use of the Service or its content requires prior written authorization from Sportfishing Report, Inc. or a separate written data or API license.

1.3 No link, reference, attribution, or credit to Sportfishing Report grants permission to copy, collect, store, republish, distribute, display, or commercially use any content or data from the Service.

2. Ownership and Intellectual Property

2.1 The Service and its content are owned by Sportfishing Report, Inc. or its licensors and are protected by copyright, trademark, and other applicable laws. Protected content includes, without limitation, fish counts; current and historical catch information; landing, boat, trip, and species information; databases and compilations; the selection, coordination, organization, and presentation of data; photographs; graphics; maps; text; reports; logos; trademarks; software; page designs; and other materials.

2.2 Except for the limited permission expressly granted in Section 1, no right, title, or interest in the Service or its content is transferred to you. All rights not expressly granted are reserved by Sportfishing Report, Inc.

2.3 SPORTFISHING REPORT, SPORTFISHINGREPORT.COM, associated logos, and related names and marks are trademarks or service marks of Sportfishing Report, Inc. They may not be used without prior written permission.

3. Prohibited Access, Scraping, and Data Use

3.1 You may not, directly or indirectly:

scrape, crawl, spider, harvest, extract, copy, download, capture, monitor, index, aggregate, or collect any content or data from the Service by automated or systematic means;
use any bot, script, scraper, crawler, browser automation, software agent, artificial intelligence system, API client, or other automated process to access or query the Service without prior written authorization;
copy, reproduce, republish, transmit, distribute, sell, license, display, or make available any current or historical fish counts or other Service content, whether in whole or in part;
create, populate, maintain, enhance, or verify any database, archive, website, application, API, data feed, artificial intelligence or machine-learning dataset, search product, analytics product, or competing service using content or data obtained from the Service;
use Service content or data for commercial purposes, competitive analysis, lead generation, marketing, resale, or the development or operation of another product or service;
circumvent or attempt to circumvent an account requirement, access control, CAPTCHA, rate limit, robots directive, blocking rule, authentication system, technical restriction, or other protective measure;
conceal or misrepresent your identity, source IP address, user agent, access method, or purpose, or rotate accounts, addresses, devices, proxies, or services to avoid detection or restrictions;
reverse engineer, decompile, disassemble, probe, test, or interfere with the Service, or attempt to gain unauthorized access to any system, account, data, or network;
remove or alter any copyright, trademark, attribution, watermark, or proprietary notice; or
authorize, assist, encourage, or enable another person or entity to do any of the foregoing.

3.2 These prohibitions apply to both public and restricted portions of the Service and to both current and historical content. They also apply when the collected information consists of facts, when only portions of the Service are collected, and when attribution or a link to Sportfishing Report is provided.

3.3 Access to the Service does not constitute permission to collect or reuse its content. Any authorized automated access, syndication, or commercial use must be governed by a separate written agreement signed by Sportfishing Report, Inc.

4. Accounts and Security

4.1 You must provide accurate information when creating an account and keep your login credentials confidential. You are responsible for activity occurring through your account.

4.2 You may not share, sell, transfer, or provide your credentials to another person or service, or permit an account to be used for automated data collection or any prohibited purpose.

4.3 You must promptly notify Sportfishing Report, Inc. if you suspect unauthorized access to or use of your account.

5. Access and Availability; Third-Party Links

5.1 The Service may contain links to third-party websites, resources, advertisers, or sponsors. Sportfishing Report, Inc. does not control and is not responsible for the availability, content, security, products, services, or practices of third-party resources. Questions or concerns about an external site should be directed to that site’s administrator.

5.2 Sportfishing Report, Inc. may modify, suspend, restrict, or discontinue any portion of the Service at any time without liability or prior notice.

6. Information, Representations, and Warranties

6.1 Fishing conditions, regulations, schedules, availability, catches, and other information can change and may be incomplete, delayed, or inaccurate. Sportfishing Report, Inc. does not represent or endorse the accuracy or reliability of any advice, opinion, statement, or information displayed, uploaded, submitted, or distributed through the Service by any user, information provider, landing, vessel, captain, government agency, or other person or entity.

6.2 Information covered by Section 6.1 includes, without limitation, daily fish-count information, IGFA world records, government fish and wildlife records, fishing regulations, trip schedules, weather, and other fishing-related information. You are responsible for independently confirming information before relying on it.

6.3 THE SERVICE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF ACCURACY, COMPLETENESS, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, SECURITY, OR UNINTERRUPTED AVAILABILITY, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

7. Limitation of Liability

7.1 TO THE MAXIMUM EXTENT PERMITTED BY LAW, SPORTFISHING REPORT, INC. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AGENTS, AFFILIATES, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING FROM OR RELATING TO THE SERVICE OR THESE TERMS.

7.2 TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF SPORTFISHING REPORT, INC. FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID DIRECTLY TO SPORTFISHING REPORT, INC. FOR USE OF THE SERVICE DURING THE SIX MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR ONE HUNDRED DOLLARS ($100).

7.3 Some jurisdictions do not allow certain exclusions or limitations. In those jurisdictions, these provisions apply only to the extent permitted by law.

8. Indemnification

8.1 You agree to defend, indemnify, and hold harmless Sportfishing Report, Inc. and its officers, directors, employees, contractors, agents, affiliates, and licensors from claims, liabilities, damages, judgments, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or relating to your violation of these Terms, misuse of the Service, infringement or violation of another party’s rights, or unlawful conduct.

9. Enforcement, Suspension, and Termination

9.1 Sportfishing Report, Inc. may investigate suspected violations and may restrict, block, suspend, or terminate access to all or part of the Service, including accounts, devices, IP addresses, networks, or automated systems, at any time and without prior notice.

9.2 Sportfishing Report, Inc. may preserve access records and other evidence and may pursue any legal or equitable remedy available for unauthorized access, scraping, copying, circumvention, infringement, interference, or other violations.

9.3 Sections concerning ownership, prohibited conduct, disclaimers, limitations of liability, indemnification, enforcement, governing law, and other provisions that by their nature should survive will remain effective after termination.

10. Copyright Complaints

10.1 If you believe material available through the Service infringes your copyright, provide a written notice identifying the copyrighted work, the allegedly infringing material and its location, your contact information, a statement of your good-faith belief that the use is not authorized, a statement under penalty of perjury that the notice is accurate and that you are authorized to act, and your physical or electronic signature.

11. Privacy

11.1 Use of the Service is also subject to the Sportfishing Report Privacy Notice. Nothing in these Terms limits the commitments expressly made in that notice.

12. Governing Law and Venue

12.1 These Terms are governed by and construed in accordance with the laws of the State of Nevada, without regard to conflict-of-law principles.

12.2 Any action arising from or relating to these Terms or the Service must be brought exclusively in the state or federal courts located in Nevada, and you consent to the personal jurisdiction and venue of those courts.

13. Changes to These Terms

13.1 Sportfishing Report, Inc. may revise these Terms from time to time. The revised Terms will be posted with an updated “Last Updated” date. Your continued use of the Service after revised Terms become effective constitutes acceptance of the revised Terms.

14. Miscellaneous

14.1 These Terms and any additional written terms applicable to a particular feature constitute the agreement between you and Sportfishing Report, Inc. concerning the Service.

14.2 If any provision is found unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions will remain in effect.

14.3 Failure to enforce a provision is not a waiver. You may not assign your rights or obligations under these Terms without prior written consent from Sportfishing Report, Inc.
